THE TOMB STUDIO Terms & Conditions
Effective Date: May 5, 2026
1. Acceptance of Terms
By booking a session, purchasing a gift card, submitting an off-site service order, or using any services provided by The Tomb Studio (operated by Free Water Entertainment), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use our services.
These Terms & Conditions constitute a binding agreement between you ("Client" or "Artist") and The Tomb Studio ("Studio"). By completing a checkout through our payment processor, you explicitly acknowledge that you have read, understood, and accepted these terms.
2. Booking & Payment
2.1 Reservation Process
All sessions at The Tomb Studio are reserved through our website via our secure checkout system, powered by Stripe and PayPal. Your time slot is held the moment payment is confirmed and not a second sooner. If payment processes but the booking page does not redirect, the webhook will still confirm your booking automatically.
2.2 Payment Options
When booking a session, you may choose between two payment options:
Deposit Only:
Pay the required deposit amount to secure your time slot. The remaining balance is due at the start of your session.
Pay in Full:
Pay the total session cost upfront in a single transaction.
2.3 Currency & Processing
All prices are listed and charged in U.S. dollars (USD). Payments are processed through Stripe or PayPal. Upon successful payment, you will receive an email receipt and booking confirmation visible on your dashboard.
3. Deposits
Deposits are a portion of the total session cost applied toward your booking. They are not a separate fee. The deposit secures your time slot and is deducted from the total session price.
Deposit amounts vary by engineer and session type. Specific deposit amounts are displayed during the booking process on the services or booking page.
Deposits are non-refundable except under the conditions stated in the 48-hour cancellation window (Section 5).
4. Reschedule Policy
4.1 Reschedule Window
You may reschedule your session free of charge if you provide at least 24 hours notice before your scheduled start time. Rescheduling requests can be submitted through your dashboard on our website or by calling/texting (330) 776-5523.
4.2 Reschedule Limit
Each booking allows a maximum of two (2) reschedules, provided 24 hours notice is given for each.
If you fail to show up for your second scheduled session (after one reschedule), you will not receive a refund for the session.
If you attempt to reschedule a third time, you will be given two options: cancel the session with no deposit refund, or keep and attend the second rescheduled date. No further reschedules will be permitted.
4.3 Late Reschedule
Reschedule requests made less than 24 hours before the scheduled start time will be treated as a late cancellation, and the deposit will be forfeited.
5. Cancellation Policy
5.1 48-Hour Cancellation Window
You may cancel your session and receive a full refund of your deposit or payment if you notify us at least 48 hours prior to the scheduled start time. Cancellation requests can be submitted through your dashboard on our website or by calling/texting (330) 776-5523.
5.2 Late Cancellation (Less Than 48 Hours)
Cancellations made less than 48 hours before the session will result in forfeiture of the deposit.
If you paid in full, the remaining balance after deducting the deposit will be issued as studio credit (see Section 7).
5.3 Refund Processing
Approved refunds will be processed within 5-10 business days and returned to the original payment method.
5.4 Studio-Initiated Cancellation
If The Tomb Studio cancels your session for any reason, you will receive either a full refund or the next available equivalent time slot, at your preference.
6. No-Show Policy
If you fail to show up for your session without prior notice, you will forfeit your deposit.
If you paid in full, the remaining balance after deducting the deposit will be issued as studio credit (see Section 7). The same studio credit terms apply to no-shows as to late cancellations.
7. Studio Credit & Refunds
7.1 Studio Credit
Studio credit is issued when the remaining balance from a late cancellation or no-show exceeds the forfeited deposit amount. Studio credit can be applied toward future session bookings, including the deposit portion of a new booking.
7.2 Studio Credit Refunds
Studio credits are non-refundable. Refund requests for studio credits will be reviewed on a case-by-case basis. Approved refunds of studio credit will result in account closure.
8. Unpaid Balances
Any remaining balance owed for services rendered that is not paid at the time of the session or upon delivery of off-site work will be considered an unpaid balance.
Unpaid balances will incur a 10% monthly interest charge on the original outstanding amount, beginning 30 days after the balance becomes due. Interest will continue to accrue monthly until the balance is paid in full.
The Tomb Studio reserves the right to send unpaid balances to collections. The client is responsible for all collection costs, including any legal fees incurred in the recovery process.
9. File Release & Retention
9.1 File Release
No recorded files, session projects, mixes, masters, stems, or any other deliverables in any format (digital or physical) will be released until The Tomb Studio receives full payment for all services rendered.
If a remaining balance is owed, files will be held until the balance is paid in full. This applies to both in-studio session files and off-site service deliverables.
9.2 File Retention
As a courtesy, The Tomb Studio will retain session files for a minimum of 12 months from the date of the session. After 12 months, The Tomb Studio makes no guarantees regarding file availability. Project files may no longer be available to be opened, edited, or modified.
The Tomb Studio is not responsible for any files that are misplaced, deleted, overwritten, or otherwise unfound after you leave the studio. It is your responsibility to verify that you have received all files before departing your session.
While we make every effort to preserve your work, we strongly encourage all clients to download and back up their files as soon as they are made available.
10. Chargeback & Dispute Resolution
10.1 Authorized Charges
By completing a checkout through our payment processor (Stripe or PayPal), you confirm that the charge is authorized and that you understand and accept the session terms. All transactions generate a digital record including transaction timestamps, booking confirmations, and payment receipts.
10.2 Dispute Process
If you have a concern about a charge, we encourage you to contact us directly before initiating a dispute with your bank or credit card company. We are committed to resolving issues fairly and promptly.
10.3 Fraudulent Chargebacks
Chargebacks filed for services that were rendered and delivered as agreed will be disputed through our payment processor. Evidence submitted may include transaction records, booking confirmations, communication logs, and studio surveillance records.
Unresolved fraudulent disputes may result in:
Immediate suspension of your account pending resolution
Permanent ban from future bookings
Pursuit of the disputed amount through small claims court in Summit County, Ohio
11. Service-Specific Terms
The Tomb Studio offers multiple service types. The following terms apply in addition to the general booking terms above. Current pricing for all services is available on our booking and services pages.
11.1 Recording Sessions
Standard recording sessions are booked by the hour with a specific engineer. Rates vary by engineer and session length. See the booking page for current pricing.
11.2 Add-On Sessions
30-minute add-on sessions are available and can only be booked in addition to an existing session. They cannot be booked as standalone sessions. Add-on availability and pricing may vary by engineer.
11.3 Classes
The Tomb Studio offers instructional classes in music production and related skills. The same cancellation and reschedule policies apply to classes as to recording sessions. See the booking page for available classes and pricing.
11.4 Studio Rental
Studio rental allows you to use the studio space and equipment for music-related purposes. A studio associate will be present during all rental sessions.
Studio rentals are restricted to music-related activities only, including but not limited to: recording, mixing, mastering, beat production, artist development, and consulting. Studio rentals may not be used for birthday parties, social gatherings, or any other activities unrelated to music creation and production.
During rental sessions, you are responsible for all studio equipment. You are financially liable for any damage caused by negligence or misuse. Normal wear and tear from standard recording use (e.g., routine microphone handling, standard cable connections, normal knob and fader operation) is not considered damage. Damage includes but is not limited to: spills on equipment, dropped or broken microphones, damaged cables from improper handling, unauthorized equipment modifications, or damage caused by guests.

11.5 Voiceover Recording
Voiceover sessions include professional engineering in a treated recording environment. The same booking, cancellation, and reschedule policies apply. See the booking page for current pricing.
11.6 Podcast Recording
Podcast recording sessions include both audio and video recording with a dual-camera setup. The same booking, cancellation, and reschedule policies apply. See the booking page for current pricing.
11.7 Consultations
Consultations are offered free of charge. In-person consultations are limited to one per three months per client. Phone consultations are limited to one per month per client.
12. Gift Card Policy
12.1 Gift Card Types
The Tomb Studio offers two tiers of gift cards:
Standard Gift Cards:
Available in multiple denominations. Valid for 30 days from date of purchase.
Premium Gift Cards:
Available in higher denominations with a bonus credit included. Valid for 90 days from date of purchase.
Specific denominations and bonus amounts are listed on the gift card purchase page.
12.2 Gift Card Usage
Gift cards are a universal studio currency and can be applied toward any Tomb Studio service, including recording sessions, classes, studio rentals, voiceover sessions, podcast sessions, off-site services (mixing, mastering, beats, stems, alternative mixes), and studio merchandise.
12.3 Gift Card Restrictions
Gift cards cannot be purchased using another gift card.
Gift cards cannot be combined with discount or promotional codes at the time of purchase.
Gift cards are non-transferable after activation unless otherwise approved by studio management.
Expired gift cards cannot be reactivated or refunded.
12.4 Gift Card Refunds
Gift cards may be refunded within 48 hours of purchase, provided the card has not been used. After 48 hours or after any portion of the balance has been redeemed, gift cards are non-refundable.
13. Discount & Promotional Codes
All discounts cannot be combined with any other discounts.
One free studio hour per Star Artist achievement.
Free hours must be used before the end of the month in which they are awarded.
Promotional codes are subject to terms specified at the time of the promotion, including expiration dates and eligible services.
The Tomb Studio reserves the right to modify or cancel any promotional offer at any time without prior notice.
Discount codes cannot be applied retroactively to completed bookings.
14. Star Artist Program
14.1 Overview
The Star Artist program is a monthly recognition and rewards program that recognizes The Tomb Studio's most active and dedicated artists across six award categories.
14.2 Awards & Free Hours
Each Star Artist award earns the recipient one (1) free studio hour. Award categories are:

Most Sessions Booked
Honorable Mention
Most Growth on Spotify
Top Supporter
Most Dedicated
14.3 Free Hour Terms
One free studio hour per Star Artist achievement.
Free hours can be applied to recording sessions, classes, or studio rentals only.
Free hours cannot be combined with any other discounts or promotional codes.
Free hours must be used before the end of the month in which they are awarded.
Free hours have no cash value and are non-transferable.
Free hours cannot be applied to voiceover, podcast, off-site services, or consultation bookings.
15. Off-Site Services
15.1 Services Offered
The Tomb Studio offers the following off-site (remote) services:
Mixing & Mastering (stem-tiered pricing)
Mastering Only
Custom Beat Production
Alternative Mixes
Alternative mixes are modified versions of a completed mix. The following alternative mix types are available:
Acappella Mix:
All vocal tracks isolated, minus any beat, transition sounds, or other non-artist-created noise not made by the artist's vocals.
Clean Mix:
The full song with all curse words removed.
Radio Mix:
The full song with all curse words, sexual references, and drug references removed.
Instrumental Mix:
The opposite of an acappella mix. All sounds that are not the artist's vocals, including the beat, transitions, and any production elements.
Performance Mix:
A version of the song with the main vocals removed, while keeping all libs, dubs, and vocal layers intact. In some cases, the performance mix may include changes to the beat arrangement and retain hook vocals for live performance use.
Show Mix:
A mix that combines multiple tracks together for live show use. Show mixes are priced by the number of songs included.

Stems
All off-site services require full payment upfront before work begins.
15.2 Turnaround Times
Off-site services are available at three turnaround tiers:
Standard (5-7 business days):
Base price. Standard turnaround for all off-site services.
Rush (2-3 business days):
1.5x the base price.
Immediate (24 hours):
2.5x the base price.
15.3 Deliverables & Revisions
The first deliverable provided to you is considered the final product. Mixing, mastering, and custom beat services include two (2) free revisions to the final product. Revisions are modifications and adjustments to the delivered final product, not a continuation of the production process.
After the second revision, additional revisions may be subject to additional charges.
Once the final product has been delivered and accepted, no refunds will be issued for off-site services.
15.4 Delivery
All completed off-site work is delivered through Tomb Cloud (our secure file delivery platform). Deliverables may also be sent through Google Drive as a backup to Tomb Cloud.
16. Tipping
Tipping is optional and available only when paying the full session balance (not on deposit-only payments). Preset tip options and a custom tip amount are available during checkout.
100% of all tips go directly to the engineer who worked your session.
17. Intellectual Property
17.1 Artist-Owned Content
You retain full ownership of all vocal recordings and performances created during your session at The Tomb Studio. The studio and its engineers claim no rights to your original vocal performances or lyrics.
17.2 Studio-Produced Instrumentals
If your project uses instrumentals, beats, or productions created by engineers or producers affiliated with The Tomb Studio, ownership of those instrumentals remains with the creator unless a separate agreement is made. Purchasing a beat or custom production grants you a license to use it as agreed upon at the time of purchase, but does not transfer ownership of the underlying composition unless explicitly stated.
17.3 Final Mixes
The final mixed and mastered recordings are owned by you, the artist. However, if the instrumental was produced by a studio-affiliated engineer or producer, the terms of that instrumental agreement apply separately.
18. Content Responsibility
The Tomb Studio provides recording, mixing, mastering, and production services. The studio does not review, approve, or endorse the content of any recordings made by clients.
You are solely responsible for all content recorded, produced, or distributed through our services, including but not limited to lyrics, spoken word, voiceover scripts, and podcast content. You represent and warrant that your content does not:
Infringe on the intellectual property rights of any third party (including unauthorized samples, beats, or copyrighted material)
Contain defamatory, threatening, or harassing statements directed at identifiable individuals
Violate any applicable local, state, or federal law
The Tomb Studio reserves the right to refuse or terminate a session if, in its sole judgment, the content being recorded poses a legal risk to the studio or its staff. No refund will be issued in such cases.
19. Indemnification & Hold Harmless
You agree to indemnify, defend, and hold harmless The Tomb Studio, Free Water Entertainment, its owners, engineers, employees, and contractors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees and court costs) arising out of or related to:
Your use of studio services or presence on studio premises
Content you record, produce, distribute, or release using studio services
Any breach of these Terms & Conditions
Any violation of applicable law by you or your guests
Any claim by a third party related to your recordings or content (including copyright infringement, defamation, or privacy violations)
Any injury, loss, or property damage caused by you or your guests while on studio premises
This indemnification obligation survives the termination of your relationship with The Tomb Studio and applies regardless of whether the claim arises during or after your use of our services.
20. Studio Rules & Conduct
20.1 General Conduct
All clients and guests must treat staff, other clients, and studio property with respect. Disorderly, aggressive, or disruptive behavior will result in immediate session termination without refund. The Tomb Studio reserves the right to refuse service to anyone at any time.
20.2 Guest Policy
A maximum of 10 people total are allowed in the studio at any time, unless prior written approval is given. You are responsible for the behavior of your guests.
20.3 Smoking & Substances
No smoking of any kind (cigarettes, cigars, Black & Milds, vapes, or marijuana) is permitted inside the studio. Violation of this policy will result in a $250 penalty per occurrence, charged to the client on file for the session.
No illegal drugs are permitted on the premises. Alcohol is permitted only if the session area is closed and approved by studio staff.
20.4 Equipment & Property
Do not touch, move, or adjust any studio equipment without permission from the engineer. Any damage caused by you or your guests will be your financial responsibility. All drinks and food must be kept away from studio equipment.
20.5 Session Time & Punctuality
Sessions begin at the scheduled start time. Late arrivals do not extend your session. Setup, breakdown, and file transfer time are included in your booked session time.
20.6 Cleanliness
Please clean up after yourself before leaving the studio. By booking a session, you agree to leave the space in the condition you found it.
21. Media, Promotional Use & Live Streams
21.1 Promotional Use
By using The Tomb Studio's services, you consent to the studio's use of photographs, video footage, and audio clips captured during your session for promotional purposes, including but not limited to social media posts, website content, and marketing materials.
This consent does not extend to unreleased music or confidential creative content. Promotional use is limited to behind-the-scenes imagery, studio environment photos, and general session documentation.
If you do not wish to be featured in promotional materials, you must notify your engineer before the session begins. Requests to remove previously published promotional content can be submitted to contact@thetombstudio.com.
21.2 Live Streams
Live streaming of studio sessions is entirely opt-in. The Tomb Studio will never live stream your session without your explicit consent. If you would like your session to be live streamed, you may opt in through your booking on our website. Live stream opt-in is only available through the website and cannot be arranged by phone, email, or in person.
By opting in to live streaming, you acknowledge that your session may be broadcast on any number of The Tomb Studio's platforms, including but not limited to YouTube, Instagram, X (formerly Twitter), Twitch, Kick, Rumble, Facebook, and TikTok.
Live stream recordings remain the property of The Tomb Studio. You are welcome to download and use any live stream content featuring your session for your own promotional purposes.
If for any reason you would like a previously published live stream removed, you may submit a request to contact@thetombstudio.com and we will accommodate your request.
22. Privacy Policy
22.1 Information We Collect
When you use our website, book a session, or interact with our services, we may collect the following information:
Name, email address, and phone number
Service preferences and booking history
Payment transaction records (processed securely through Stripe and PayPal; we do not store credit card numbers)
Gift card purchase and usage history
Spotify public data (monthly listener counts) for Star Artist program participants
Session metadata (date, time, engineer, service type)
Any other information you voluntarily provide through forms or communication
22.2 How We Use Your Information
To process bookings and payments
To communicate with you about your sessions and services
To send updates, promotions, and studio news (with your permission)
To administer the Star Artist program and track award eligibility
To manage gift card balances and redemptions
To maintain business records and improve our services
22.3 Data Protection
We implement industry-standard security measures to protect your data from unauthorized access, misuse, or disclosure. We do not sell, rent, or share your personal information with third parties.
22.4 Payment Processing
Payments are processed through Stripe and PayPal. When payment is split between the studio and an engineer, your payment information is handled entirely by the payment processor and is subject to their respective privacy policies. The Tomb Studio does not have access to your full credit card or PayPal account details.
22.5 Cookies & Website Data
Our website may use cookies and similar technologies to enhance your browsing experience. You can choose to disable cookies through your browser settings.
22.6 Google Advertising
We may use Google Ads to reach potential clients. If you arrive at our website through a Google ad, Google may collect certain browsing data as described in Google's privacy policy. We only use advertising to reach potential clients and do not share your personal booking information with advertising platforms.
22.7 Text Message & Email Communication
By providing your phone number and/or email address, you acknowledge that you may receive communications via SMS and email regarding your bookings, promotions, and studio updates. Message and data rates may apply. Reply STOP to opt out of text messages at any time. No mobile information will be shared with third parties for marketing or promotional purposes.
22.8 Data Requests
To request access to, correction of, or deletion of your personal information, contact us at contact@thetombstudio.com or (330) 776-5523.
23. Limitation of Liability
23.1 Safety & Personal Property
The Tomb Studio is not responsible for any personal injury or loss of personal property that occurs on the premises. You enter and use the studio at your own risk.
23.2 Service Limitations
While we strive to deliver the highest quality service, The Tomb Studio does not guarantee specific artistic or commercial outcomes from any session, class, or off-site service.
23.3 Maximum Liability
In no event shall The Tomb Studio's total liability to you for any and all claims arising out of or related to our services exceed the total amount you paid to The Tomb Studio for the specific service giving rise to the claim.
24. Force Majeure
The Tomb Studio shall not be held liable for any failure or delay in performing its obligations under these Terms & Conditions where such failure or delay results from circumstances beyond its reasonable control, including but not limited to:
Natural disasters (floods, earthquakes, severe weather)
Power outages or utility failures
Internet or telecommunications outages
Equipment failure beyond the studio's control
Government actions, orders, or regulations
Pandemics, epidemics, or public health emergencies
Acts of war, terrorism, or civil unrest
In the event of a force majeure occurrence, The Tomb Studio will notify affected clients as soon as reasonably possible and will offer either a full refund or rescheduling to the next available equivalent time slot.
25. Governing Law & Jurisdiction
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms & Conditions or the use of The Tomb Studio's services shall be resolved exclusively in the courts of Summit County, Ohio. By using our services, you consent to the personal jurisdiction of the courts in Summit County, Ohio.
26. Modifications to Terms
The Tomb Studio reserves the right to modify these Terms & Conditions at any time. Updated terms will be posted on our website. Clients with active bookings will be notified of material changes prior to their implementation. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
